N\u00b0 32330 Ley que modifica el C\u00f3digo Penal y el C\u00f3digo de Responsabilidad Penal de Adolescentes"},"content":{"rendered":"<p>La Ley N\u00b0 32330, que modifica el C\u00f3digo Penal, Decreto Legislativo 635, y el C\u00f3digo de Responsabilidad Penal de Adolescentes, Decreto Legislativo 1348, para incorporar a los adolescentes de 16 y 17 a\u00f1os como sujetos imputables dentro del sistema penal, promulg\u00f3 el Poder Ejecutivo.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"724\" height=\"1024\" C\u00f3digo Penal y se\u00f1ala que estar\u00e1 exento de responsabilidad penal el menor de 18 a\u00f1os, con excepci\u00f3n de los adolescentes de 16 y menos de 18 a\u00f1os, que cometen alguno de los delitos tipificados en los art\u00edculos 107, 108, 108- A, 108-B, 108-C, 108-D, 121, 121-B, 129-A, 129- B, 129-C, 129-D, 129-G, 129-H, 129-I, 129-K, 129-L, 129-M, 129-\u00d1, 148-A, 152, 170, 171, 172, 173, 179, 180, 181, 189, 200, 279, 279-G, 280, 281, 296, 296-A, 296-B, y los numerales 4, 5 y 6 del art\u00edculo 297, as\u00ed como los art\u00edculos 303-C, 317, 317-A, 317-B y 326 del cuerpo normativo.<\/p>\n\n\n\n<p>As\u00ed como por alguno de los delitos tipificados en el Decreto Ley N\u00b0 25475, que establecen la penalidad para los delitos de terrorismo y los procedimientos para la investigaci\u00f3n, la instrucci\u00f3n y el juicio.&nbsp;&nbsp;<\/p>\n\n\n\n<p>El art\u00edculo 22 detalla que podr\u00e1 reducirse prudencialmente la pena se\u00f1alada para el hecho punible cometido, cuando el agente tenga entre 16 y menos de 21 a\u00f1os, o m\u00e1s de 65 al momento de realizar la infracci\u00f3n, salvo que haya incurrido en forma reiterada en los delitos previstos en los art\u00edculos 111, tercer p\u00e1rrafo, y 124, cuarto p\u00e1rrafo.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"724\" height=\"1024\" art\u00edculo I del C\u00f3digo de Responsabilidad Penal de Adolescentes se\u00f1ala que el adolescente entre 14 y menos de 18 a\u00f1os ser\u00e1 sujeto de derechos y obligaciones, y responder\u00e1 por la comisi\u00f3n de una infracci\u00f3n en virtud de una responsabilidad penal especial, consider\u00e1ndose para ello su edad y caracter\u00edsticas personales.&nbsp;<\/p>\n\n\n\n<p>Si el adolescente tiene entre 16 y menos de 18 a\u00f1os y comete los delitos se\u00f1alados en el numeral 2 del art\u00edculo 20 del C\u00f3digo Penal, se le aplicar\u00e1 responsabilidad penal ordinaria,
