{"id":13463,"date":"2025-03-10T21:11:24","date_gmt":"2025-03-11T02:11:24","guid":{"rendered":"https:\/\/esford.pe\/?p=13463"},"modified":"2025-05-20T11:57:22","modified_gmt":"2025-05-20T16:57:22","slug":"nuevas-reglas-para-la-detencion-preliminar-en-peru-lo-que-dice-la-ley-32255","status":"publish","type":"post","link":"https:\/\/esford.pe\/ing\/nuevas-reglas-para-la-detencion-preliminar-en-peru-lo-que-dice-la-ley-32255\/","title":{"rendered":"LEY N.\u00b0 32255: Nuevas reglas para la detenci\u00f3n preliminar en Per\u00fa."},"content":{"rendered":"<p>El Congreso de la Rep\u00fablica public\u00f3 la Ley N\u00b0 32255, que restituye y modifica el literal a) del numeral 1 del art\u00edculo 261\u00b0 del Nuevo C\u00f3digo Procesal Penal (Decreto Legislativo N\u00b0 957), referido a la detenci\u00f3n preliminar judicial en casos de no flagrancia.<\/p>\n\n\n\n<p>Seg\u00fan esta norma, el juez de la investigaci\u00f3n preparatoria, a solicitud del fiscal, emitir\u00e1 una resoluci\u00f3n debidamente motivada con base en las actuaciones remitidas por este y podr\u00e1 dictar mandato de detenci\u00f3n preliminar cuando no se configure un supuesto de flagrancia delictiva. Esto proceder\u00e1 siempre que existan elementos razonables para considerar que una persona ha cometido un delito sancionado con pena privativa de libertad superior a cuatro a\u00f1os y, adem\u00e1s, se presenten indicios de riesgo de fuga u obstaculizaci\u00f3n de la investigaci\u00f3n.<\/p>\n\n\n\n<p>Asimismo, la detenci\u00f3n preliminar ser\u00e1 aplicable cuando una persona sorprendida en flagrante delito logre evadir su captura o cuando un detenido se fugue de un centro de detenci\u00f3n preliminar.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#fd0538\"
