ley que faculta a familiares directos a representar a menores en juicios de alimento"},"content":{"rendered":"<p><strong>El Pleno del Congreso de la Rep\u00fablica aprob\u00f3, con 97 votos a favor, una modificaci\u00f3n al C\u00f3digo Procesal Civil que permitir\u00e1 a abuelos, t\u00edos o hermanos mayores ejercer la representaci\u00f3n legal en procesos de alimentos de menores, en ausencia del padre o madre responsable de su tenencia.<\/strong><\/p>\n\n\n\n<p>La iniciativa, que modifica el art\u00edculo 561 del mencionado c\u00f3digo, busca garantizar el bienestar integral de ni\u00f1os, ni\u00f1as y adolescentes.<\/p>\n\n\n\n<p>Los proyectos de ley 3843\/2022-CR y 5266\/2022-CR, impulsados por los congresistas Alejandro Soto Reyes (APP) y Am\u00e9rico Gonza Castillo (PL), incluyen esta disposici\u00f3n como el numeral 9 del art\u00edculo 561.<\/p>\n\n\n\n<p>Seg\u00fan explic\u00f3 Isaac Mita Alanoca, presidente de la Comisi\u00f3n de Justicia y Derechos Humanos, los alimentos comprenden todo lo indispensable para el sustento, habitaci\u00f3n, vestido, asistencia m\u00e9dica, educaci\u00f3n, instrucci\u00f3n y capacitaci\u00f3n para el trabajo.<\/p>\n\n\n\n<p><em><strong>\u201cEsta modificaci\u00f3n va en consonancia con lo dispuesto en la Convenci\u00f3n sobre los Derechos del Ni\u00f1o\u201d<\/strong><\/em>, destac\u00f3 Mita Alanoca, subrayando que el objetivo es asegurar el acceso de los menores a educaci\u00f3n, vivienda, transporte, asistencia m\u00e9dica y recreaci\u00f3n, elementos clave para su desarrollo integral y un nivel de vida adecuado.<\/p>\n\n\n\n<p>Adem\u00e1s de los abuelos, t\u00edos y hermanos mayores, tambi\u00e9n est\u00e1n facultados para ejercer la representaci\u00f3n procesal el apoderado judicial del demandante, el padre o madre del menor, el tutor, el curador, los defensores de menores (Ministerio P\u00fablico) y los directores de establecimientos de menores, entre otros.<\/p>\n\n\n\n<p>La propuesta fue exonerada de segunda votaci\u00f3n con 92 votos a favor, lo que permitir\u00e1 su env\u00edo al Poder Ejecutivo para su eventual promulgaci\u00f3n.<\/p>\n<div
