{"id":11830,"date":"2025-01-08T10:40:21","date_gmt":"2025-01-08T15:40:21","guid":{"rendered":"https:\/\/esford.pe\/?p=11830"},"modified":"2025-01-13T19:31:07","modified_gmt":"2025-01-14T00:31:07","slug":"ley-n-32228-en-que-medida-afecta-los-procesos-judiciales-de-familia","status":"publish","type":"post","link":"https:\/\/esford.pe\/ing\/ley-n-32228-en-que-medida-afecta-los-procesos-judiciales-de-familia\/","title":{"rendered":"Ley N\u00b0 32228: En que medida afecta los procesos judiciales de familia"},"content":{"rendered":"<p>El Poder Ejecutivo public\u00f3 la Ley N\u00b0 32228 que modifica el C\u00f3digo Civil (Decreto Legislativo N\u00b0 295) para incluir los principios generales aplicables a los procesos en materia de familia.<\/p>\n\n\n\n<p>Seg\u00fan la norma aprobada por el Congreso de la Rep\u00fablica, dichos procesos deber\u00e1n respetar los principios de oralidad, tutela judicial efectiva, inmediaci\u00f3n, buena fe, lealtad procesal y oficiosidad.<\/p>\n\n\n\n<p>En los casos que involucren derechos de ni\u00f1as, ni\u00f1os y adolescentes, los jueces estar\u00e1n obligados a evaluar los hechos y circunstancias bajo un enfoque que priorice la vulnerabilidad de la persona durante las etapas de infancia y adolescencia. Adem\u00e1s, deber\u00e1n garantizar en todo momento el inter\u00e9s superior del menor y su derecho a participar activamente en los procesos que los afecten.<\/p>\n\n\n\n<p>Como resultado, se incorpora al C\u00f3digo Civil el art\u00edculo 233-A, denominado Principios generales de los procesos de familia.<\/p>\n<div class=\"fb-background-color\">\n\t\t\t  <div \n\t\t\t  \tclass =
